Terms of Service

1. Acceptance of Terms

By accessing or using TurnMeOn (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

2. Description of Service

TurnMeOn is a social dating and matching platform that allows users to:

• Create personal profiles with photos, biographical information, interests, and preferences
• Discover and match with other users through swipe-based discovery, algorithmic recommendations, and location-based features
• Communicate via in-app messaging once a mutual match occurs
• Access optional premium features that increase visibility and matching opportunities

The Service uses user-provided information, location data (when permitted), and proprietary algorithms to suggest potential matches. We do not guarantee any specific number or quality of matches.

3. Eligibility

To use the Service you must:

• Be at least 18 years of age (or the age of legal majority in your jurisdiction)
• Have the legal right and capacity to enter into these Terms
• Not be prohibited from using online dating or social platforms under applicable law
• Provide accurate information about your age, identity, and relationship status

We reserve the right to suspend or terminate any account that we reasonably believe violates these eligibility requirements, including accounts created by minors or with materially false information.

4. User Accounts

• You must create an account to use the Service.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are fully responsible for all activities that occur under your account.
• You agree to provide accurate, current, and complete information during registration and to keep it updated.
• You must notify us immediately of any unauthorized use of your account.
• You may only maintain one active account per person. Creating multiple accounts may result in termination of all accounts.

5. User Content and Profiles

Your Content

You retain ownership of all photos, videos, text (bios, prompts, messages), and other content you upload or create through the Service ("User Content").

By uploading or creating User Content, you grant TurnMeOn a worldwide, non-exclusive, royalty-free, sublicensable license to host, display, reproduce, adapt (for formatting and presentation), and distribute your User Content solely as necessary to:

• Operate and provide the matching and messaging features of the Service
• Show your profile to other users
• Improve our recommendation algorithms
• Enforce these Terms and our Community Guidelines

You represent and warrant that you have all necessary rights to grant this license and that your User Content does not violate any law or the rights of any third party.

We reserve the right (but have no obligation) to review, moderate, edit, or remove any User Content that we determine, in our sole discretion, violates these Terms, our Community Guidelines, or applicable law.

Our Content

All software, algorithms, interfaces, documentation, trademarks, and other intellectual property related to the Service are the exclusive property of TurnMeOn or its licensors. You may not copy, modify, distribute, or create derivative works without prior written consent.

6. Acceptable Use and Community Guidelines

You agree not to use the Service to:

• Violate any applicable law or regulation
• Harass, threaten, abuse, defame, or discriminate against other users
• Send unsolicited explicit, sexual, or pornographic content
• Create fake, misleading, or impersonating profiles
• Use the Service for commercial sexual activity, escort services, or solicitation
• Spam, scam, phish, or attempt to defraud other users
• Upload or transmit viruses, malware, or malicious code
• Reverse engineer, decompile, or attempt to extract source code or algorithms
• Impose an unreasonable load on our infrastructure
• Infringe the intellectual property or privacy rights of others
• Engage in any behavior that we reasonably determine is harmful to the community or the Service

7. Matching, Messaging & User Interactions

The Service is a tool to help people connect. We do not:

• Guarantee that you will receive any matches or messages
• Verify the identity, background, or intentions of other users (except for optional verification features we may offer)
• Control or monitor all user communications

You are solely responsible for your interactions with other users, both online and offline. We strongly recommend exercising caution, meeting in public places, and informing a trusted person of your plans when meeting someone from the app. TurnMeOn is not responsible for the conduct, statements, or actions of any user, or for any harm that may result from interactions facilitated by the Service.

8. Subscriptions, Payments, Cancellation & Refunds

Subscription Plans

TurnMeOn offers Free and Premium subscription tiers. Payments are securely processed through Paddle. All fees are exclusive of applicable taxes.

Automatic Renewal

Paid Subscriptions automatically renew until cancelled. You will be charged between 00:00 and 01:00 (UTC) on the renewal date.

Cancellation

To cancel, contact Paddle at paddle.net at least 48 hours before the end of the current billing period. There are no refunds for unused subscription periods, except as required by applicable consumer law.

Free Trials

If a subscription includes a free trial, you must cancel before the trial ends to avoid being charged.

9. Consumer Right to Cancel (EU & UK Residents)

If you are a consumer in the European Union or United Kingdom, you have the legal right to cancel your initial Premium subscription within 14 days without giving a reason. To exercise this right, inform Paddle before the 14-day period expires via paddle.net.

Note: Your right to cancel does not apply if you have already started using Premium features during the cancellation period and have expressly consented to waive this right.

10. Privacy

Your use of the Service is governed by our Privacy Policy. We collect and process personal data to provide matching services, improve recommendations, ensure safety, and operate the platform. We do not sell your personal information except as described in the Privacy Policy or required by law.

11. Third-Party Services

The Service integrates with:

• Paddle (payment processing)
• Supabase (authentication, database, and storage)
• Cloudflare (hosting and CDN)
• Other service providers for push notifications, analytics, and app distribution

12. Safety and Reporting

We provide tools to block and report users. If you encounter harassment, inappropriate content, or behavior that violates these Terms, please report it immediately through the app. While we work to maintain a safe environment, we cannot guarantee your safety.

13. Termination

We may suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in illegal or abusive behavior, create fake or multiple accounts, or impose excessive load on our systems. You may terminate your account at any time through the app settings or by contacting support.

14. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "AS IS" without warranties of any kind, express or implied.
• We are not liable for indirect, incidental, special, consequential, or punitive damages.
• Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim.
• We are not responsible for lost profits, data loss, or any harm resulting from interactions with other users.

15. Indemnification

You agree to defend, indemnify, and hold harmless TurnMeOn and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your User Content, your interactions with other users, or your violation of these Terms.

16. Binding Arbitration and Class Action Waiver

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

• You waive the right to participate in a class action lawsuit or class-wide arbitration.
• Arbitration will be conducted on an individual basis only.
• This provision survives termination of these Terms.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Delaware.

18. Miscellaneous

• Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
• No Waiver: Our failure to enforce any right does not constitute a waiver.
• Severability: If any provision is unenforceable, the remainder remains in effect.
• Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and TurnMeOn.
• Export Compliance: You may not use the Service in violation of U.S. export laws.

19. DMCA / Copyright Complaints

If you believe that any User Content on the Service infringes your copyright, please send a DMCA notice to dmca@turnmeon.app containing the information required by the DMCA.
